Co-Workers can be held individually liable for actions taken against other co-workers, regardless of wether their employer knew or should have known about conduct and wether the employer took corrective action.

Can conduct that does not rise to the level of harassment or hostile work environment be subject to remedial action?
Yes, while some behavior might not meet the legal definition of a hostile work environment, it may still constitute inappropriate behavior in the work place and be subject to remedial action.
What you a member do if they believe they are unlawfully harassed or discriminated against by another person in the work place?
- Tell the offender in a clear manner that their conduct is unwelcome and to stop
- If not comfortable with talking to the offender tell your immediate supervisor
- If the immediate supervisor is the offender go to the next supervisor in the chain of command.
- Can also make complaints to HR at PSD or contact the County’s Equal Employment Opportunity Access Or outside agencies EEOC or DFEH

What should a supervisor do upon learning of harassment?
Supervisors should take immediate corrective action and report complaints of sexual or unwanted harassment to PSD for investigation, Determination and resolution

To prevent harassment of any kind and to maintain a workplace free of hostility and conflict
