What does S1 Prevention of Crime Act 1953 cover?
It makes it an offence for a person, without lawful authority or reasonable excuse, to have with him in a public place, an offensive weapon
Where is defined a public place?
Anywhere the public have access to freely or pay to get in
What is instant arming
The carrying of an article innocently with no lawful intent but then, on the spur of the moment, decides to resort to using it as a weapon
What are the 3 categories of offensive weapons?
1) Made - the weapon has been manufacture for the sole purpose to injure another
2) Adapted - original form was innocent but it has been adapted to cause injury
3) Intended - has not been altered or modified but it has to be proven the person intended to cause injury
What is considered a reasonable excuse or lawful authority to carry an offensive weapon?
Work (eg chef), Religious reasons, traditional wear, lawful authority eg police
What does S139A Criminal Justice Act 1988 cover?
Makes it an offence to have an offensive weapon on school property

Any person who has with him, in a public place, any article which has a blade or is sharply pointed shall be guilty of this offence
