What is a procurement document modification called?
Addenda - issued BEFORE opening of bids/proposals
How can addenda change procurement documents?
- Change date, time, or location of receipt of bids
- Add, delete, revise procurement documents
- Include additional qualified products or approved substitutions
What are reasons for issuing modifications to the contract?
- Incorporating Owner changes (requirements, adds, deletes)
- Unforeseen site conditions
- Changes in code or AHJ requirements
- Changes in market conditions/product availability
- Corrections to contract documents to eliminate errors, omissions, conflicts
What are the AIA methods for modifying contract documents?
- Change order
- Construction change directive
- Minor change
What is a Change Order?
Written instruction that changes contract sum or time
What is a Construction Change Directive?
Written instruction directing change before agreement on sum or time change
What is a Minor Change?
Instructions that DO NOT change contract sum or time
What is the Uniform Commercial Code (UCC) and what does it do?
Primary source of commercial contract law
Article 2 - law governing contracts for the transaction of any GOODS between buyers and sellers
What are the 3 requirements of Uniform Commercial Code (UCC) written contract?
- Provide evidence that there was a contract for the sale of goods
- Must be signed by party to be charges
- Must specify a quantity
Who does the Uniform Commercial Code (UCC) protect?
- Protects seller if buyer breaches contract
- Protects buyer if seller breaches contract
What are the AIA standard purchasing documents?
A151 - Agreement between owner and vendor for FF&E
A751 - Invitation and instructions to vendors for quotes for FF&E
A152 - Purchase order (only purchase, no assembly or install)
