A patient can be detained if
They have a mental disorder that poses significant
risk to themselves or others, and treatment in the
community is not possible because of this
Holding Powers Definition
To stop patient leaving a ward, no mental health assesment needed
Section 5 (4)
Mental Health Nurse Holding Power: Can stop psychiatric patient leaving a ward up to 6 hrs to allow for assessment by a doctor
Section 5 (2)
Doctor Holding Power can stop a patient leaving any ward up to 72 hrs for Mental Health Assessment to be organised
Mental Health Section 2
Require mental health assessment
- 1 AHMP required
- 2 Section 12 Approved doctors
Can hold Px for up to 28 days for purposes of Assessement (can treat)
Mental health Assessment Section 3
Require mental health assessment
- 1 AHMP required
- 2 Section 12 Approved doctors
Can hold Px up to 6 months for treatment
- Patient has the right to appeal via tribual
Mental Health Act Section 4
Allows emergency detainment for the purpose of assessment for a duration of up to 72 hours for patients safety or protection to others.
- Application can be made by the nearest relative or an Approved Mental Health Professional (AMHP) and must be supported by one doctor. - The doctor must have examined the patient within the previous 24 hours.
