50% of these have sx but don’t need treatment
More likely in women.

Legal duties of employer
Under HSAWA and MHSAWA
- Proactively identify causes of stress
- Undertake risk assessment
- Implement measures which prevent/control risks
Duties limited to:
- Forseeability
- Degree of control
- Reasonably practical (cost vs benefit)

Used to tackle range of work and non-work related problems (alcohol, drugs, MH) that adversely affect job performance
HSAWA 1974
Requires all British organisations with more than 5 people to have a written policy about health, safety and welfare of their staff.
HSE recommends MH policies should be part of the the policy.
Should indicate measures to address prevention of work related stress, education and training.

Transport and Works Act 1992
Makes it a criminal offence for certain workers to be unfit through drink and/or drugs while working on railways/tracks.
Drunk Worker
Could be criminally liable under HASAWA 1974 under section 7.
Can cause criminal proceedings against employer if they knowingly allow them to continue in work.
Civil action against employer preferred than against employee as get more in damages.
Alcohol Policy
Agreed between management, unions and staff.
Dismissal must not be first option. Confidentiality, person rights, sick leave factored in. State role of OH.
Almost 1/3 recover without specific treatment.
Drug Policy
Like alcohol. Support affected employees and not punish them.
Clearly state possession or supplying at work will be reported immediately to the police.
