Heterosexual Intercourse - Bday Rule
14th bday - both have to be 14 or report
Hetero Cont’d 21/16
If one partner is 21 the other must be at least 16 or report
Object Consensual Pen - oral, anal or obj
21/16 - one partner is 21+, other must be at least 16 or report
Lewd Lascivious (not penetrative - mutual masturbation)
One partner under 14 - report
One partner 14 or 15, other partner 10+ years older, report
One partner 16+, not reportable
Mandate Reporting Focus
On child abuse not criminal activity
Neglect
Child does not have to have experienced neglect to report suspect neglect or circumstances where they are left in situations that could result on harm (hot car) to file a report
Investigations
Can involve multiple agencies as well as people or businesses that have taken on the responsibility to care for children. Not exclusive to parents (daycare and childcare)
Emotional Abuse
Typically when children have been exposed to DV; CPS assess the risk to a child having seen or been in that environment
Reporting - Child Abuse
Immediately by phone with 36 hours (weekends and holidays count) in writing, unless done online.
Reporting - Deb Adult or Elder
Imm by phone and 2 days following (not including weekends or holidays) unless reported online
