What is ISM?
International Safety Management Code
An internationally agreed upon code that promotes a safety culture for personnel both on board and ashore.
It ensures safety at sea, prevention of injury, damage to the environment, and maritime property.
Who is the IMO
International Maritime Organisation
Governing Body that lays down rules and regulations for international shipping, through the production of Conventions, notices and codes.
What is the purpose of a flag state?
To ensure compliance with conventions and national law, and that standards outlined are being met.
They also offer sovereign protection under their flag
What is the purpose of a Port state?
Uphold standards for any vessels operating in their waters.
They can inspect ships, through a memorandum of understanding (MOU) between certain nations, whereby they will share the results of their inspections on a thetas central database
Role of the Owner/Management Company
Produces an SMS, to be inspected by Flag state
Appoints a DPA, that has sufficient experience in the relevant sector of the Maritime Industry, that has access to the highest level of management
Role of Master
Implement SMS and SEP on board ship
Motivate the crew in the observation of the policies
Verify Requirements are observed and met
Review the SMS and report deficiencies to the Company
Role of Flag State
Issues a Document of Compliance to the company/owner, stating they comply with the code
Issues a Safe Management Certificate to the Ship
Oversees continued compliance of the company with the code
Renews certificates every five years
What is a Document of Compliance?
A certificate issued to the COMPANY, which states they have met requirements under the ISM code
Reviewed annually, replaced every 5 years
What is a Safety Management Certificate?
Document provided to a ship by Flag state, signifying that the company and its ship operate in accordance with the SMS, and therefore ISM
What is Objective Evidence?
Evidence shown by the vessel during an audit, to prove compliance

What is an SMS?
A structured and documented system, under the ISM code, which enables shipping companies and vessels within, to effectively implement safety and environmental policies.

What is a Non-conformity and a Major Non-Conformity?
Non-Conformity
When objective evidence indicates a non-fulfilment of a specific requirement, stated by the SMS.
Cannot proceed to sea until rectified
A Major NC is an extremely serious situation that poses a threat to the safety of personnel, ship, or the environment.
Requires IMMEDIATE corrective action to be taken by ships management
Where does it state that the Captain has overriding Authority?
In the SMS, and I believe in the ISPS code also
