How did you identify that it was a solid stone property?
Stone property - identified by thickness of the wall -400 in this instance and use of throughs.
Can you explain why you followed the trail and what this means.
One of the reasons a stack might be leaning is that the breast has been removed internally and not adequately supported.
If sufficient evidence exists that there is suspicion of a greater problem, then the surveyor should take reasonable steps to follow that trail until they have sufficient information prior to valuation

In this instance a chimney breast has been removed and I was unable to confirm adequate support was available.

What happened in Smith vs Bush(1989)?
Valuer noted that Chimney breast had been removed to first floor but did not check support above. Breast collapsed. Valuer did not list essential repairs. Valuer tried to rely on a disclaimer against liability to purchaser as contract with society. Failed as onus on valuer as per Unfair contract terms act 1977.

What happened in Yianni vs Evans (1981)
Surveyor missed subsidence where the repairs cost more than the house was worth and more than the mortgage. Surveyor was acting for BSociety and said contract with lender and no duty of care to purchasers. Judge held that that the applicant would rely on the valuation and as at bottom end of market, unlikely to commission private survey.
Do building regulations apply here?
Building regulation approval needed for removal of the breast.
Apply via Building Control or via an approved inspector - Part II of the Building Act 1984 and the Building (Approved Inspectors etc.) Regulations 2010.
