Employer:

  • A safe place to perform work in.
  • Ensure equipment and machinery is safe to use.
  • Must ensure work colleagues are competent in their roles.
  • Must carry out risk assessments.

Employee:

  • Take steps to protect the health and safety of themselves and colleagues.
  • Must not disrupt anything put in place to aid health and safety at work.
  • May be subject to fines and convictions if they are found in breach of the act.

What are the roles of each duty holder under CDM?

A

Client – Ensuring there are suitable arrangements for construction work to be carried out safely, that there is proper coordination between those planning, designing and managing the construction work

Principal Contractor – Manages health and safety in the construction phase, produces the construction phase plan

Principal Designer – Manages health and safety in the pre-construction phase, produces the health and safety file

Contractor – Manage and monitor the way they carry out their own construction work, cooperate and coordinate with others.

Designer – Ensure they are competent to complete design work, take account of pre-construction information and eliminate health and safety risks where possible.

Prohibition Notice - There is a serious risk to health and safety, work must be stopped immediately.

What is the Building Safety Act?

A

An act that was introduced following the Grenfell Tower fire to change the legislation for all buildings, with additional requirements for high rise buildings.

What are the overarching principles of the BSA?

A

It defines are higher risk building in England as at least 18 metres or has at least 7 storeys and contains at least 2 residential units

Hotels, Military Institutions and Prisons are excluded.

Creates the role of the Building Safety Regulator to oversee the safety of all buildings

Also creates the role of Accountable Persons who owns or has responsibility of a higher risk building

Introduces the system of the golden threat where information must be created, stored and updated throughout the life-cycle of a HRB.

Introduces Gateways where design information must be submitted at Planning (Gateway 1), Pre-Commencement on Site (Gateway 2) and Pre-Occupation (Gateway 3).

HRBs are regulated by HSE who act as the Building Safety Regulator.
