Sources of Australian Law

A

1) Legislation
Law recognised by authorities, where the state and federal government pass ‘Acts of Parliament’ such as Commonwealth Health Insurance Act (Medicare) in 1973.

2) Judge-Made Law
Law in Australia is continually developed through doctrine of precedent. i.e: Rules that have applied in past judicial decisions should be followed in future cases that are similar.

3) Indigenous Customary Law
Rules developed over thousands of years of occupation of Australia by Aboriginals and Torres Strait Islanders.
