Officer shall select the least intrusive/severe method of enforcement when considering issuing a citation in lieu of and arrest which will;
Stop existing criminal conduct
Remove the eminent threat of violence or criminal conduct
Prevent persons from endangering themselves or others
Should I arresting officer choose custodial arrest rather than a misdemeanor/sign a release citation release, the officer:
States in the office report the reason why physical address was appropriate
When issuing a misdemeanor citation/cite and release citation, the arresting officer:
Completes all sections on the citation
Shall sufficiently identify the violator
Indicate only one charge per citation
Set arrangement dates accordingly

Bexar County DA office through bin mail
Officer May issue misd. Citations to arrestees suspected of class c thefts from a business unless:
The violator has previous convictions for theft
A situation in .05 is apparent
The misd./ cite and release is not authorized in the following cases
Misd thefts other than from businesses
The AP demands an immediate appearance before a magistrate
Has outstanding warrants
Safety if the person or other May be jeopardized
Fails/refuses to ID
Overly intox
Is injured and has not been treated
Physical force has been used
Class B racing, exhibition of speed, reckless drive
Refusal to sign citation
Officers must verify all the following requirements in order to issue a class a or B misdemeanor citation
The office is eligible for a release by citation
The violator is not a juvenile
The violator reside in Bear County
