No. An employee can not be removed from a specialty pay position solely because they received an adverse action for an unrelated off-duty incident.

The Department is required to maintain records related to substance testing. The records must be considered confidential and are only releasable to:
- The employee tested
- An individual designated in writing by the employee tested.
- The medical review officer.
- The CalHR
- Individuals who need the records to:
a. supervise or assign the employee
b. determine what action the Commissioner should take in response to testing
c. Respond to appeals or litigation arising from the substance test or related actions

A reasonable suspicion report will be generated as a result of the substance testing protocol. The form the Department uses to document these incidents is the CHP 202X. Who completes this form and in what time frame? Who is the report submitted to?
The CHP 202X is completed by the supervisor who made the initial determination of reasonable suspicion and there is an expectation that the report be completed and provided to the employee within 48 hours.
It must be submitted to the manager who approved the substance testing.
