How does the Occupational Safety and Health Act benefit you as an employee?
It is intended to ensure that you can work without being exposed to hazards.
What is meant by the term ‘duty of care’ in relation to Occupational Safety and Health?
It means that a person or employer has a legal responsibility to take reasonable care in matters relating to health and safety.
List FOUR ‘duties of care’ which are the responsibility of the employer in relation to
Occupational Safety and Health?
Workplace without hazards; Provide information and training; Consult safety representatives; Provide protective materials; Use safe processes. Clause 19.
List FOUR ‘duties of care’ which are the responsibility of the employee in relation to Occupational Safety and Health?
Comply with instructions; Use protective equipment; Do not damage safety equipment; Report unsafe conditions; Report injuries. Clause 20.
What qualifications and experience must an applicant for the position of OSH Safety Representative have? Give three factors.
Must work at the workplace; Been employed for 2 years; Have 2 years’ experience in similar work; Had adequate training. Clause 31(8).
What is the general penalty if an individual employee commits an offence against the Occupational Safety and Health Act?
For an employee: A fine of $5000. Clause 54.
What TWO actions must an employee take if he or she becomes aware of a situation which is hazardous?
Attempt to remove the hazard, if possible and report the hazard.
Which TWO areas of industry are exempt from the requirements of the Occupational Safety and Health Act 1984? Why?
The mining industry and the petroleum industry are exempt because they are covered by other special legislation. Clause 4(2).
Whilst doing electrical installation work, you come across asbestos. Do you have to report it?
Yes
Who is responsible for the classification of a hazardous area?
The persons or parties in control of the installation. Clause 7.7.2.1
