What is the legal responsibility of the DVLA regarding driving fitness?
The DVLA is legally responsible for deciding if a person is medically fit or unfit to drive.
It is also the duty of psychiatrists/doctors to inform patients about how their conditions could impair driving.
What should be encouraged for patients regarding DVLA reporting?
Patients should be encouraged to report to DVLA on their own accord.
Patients can also be encouraged to seek a second opinion if they disagree.
What can a doctor do if a patient continues to drive when not fit?
The doctor can break confidentiality and involve authorities that can stop the driver.
The patient must be informed of the decision to override confidentiality before informing the DVLA.
What must occur for Group 1 drivers with acute psychosis before relicensing?
Relicensing can be considered when the following conditions are satisfied:
* The patient has remained well and stable for at least 3 months
* Is compliant with treatment
* Is free from adverse effects of medication which would impair driving
* Subject to a specialist favorable report
* Regained insight in case of bipolar mania or hypomania.
Group 1 includes car and motorcycle drivers.
What is required for Group 2 drivers before they can resume driving?
The person must be well and stable for a minimum of three years with insight into their condition.
Group 2 includes HGV drivers.
What should happen for Group 1 drivers with severe anxiety or depression?
Driving should cease pending the outcome of medical enquiry. A period of stability will be required before driving can be resumed.
This is not necessary for mild depression or anxiety seen in primary care.
What is the requirement for Group 2 drivers with severe anxiety or depression before they can drive?
Driving may be permitted only when the person is well and stable for a period of six months.
Group 2 includes HGV drivers.
How is the driving license for patients with dementia managed?
The license in early stages is subject to annual review for Group 1 drivers; but Group 2 drivers will get their license revoked.
Group 1 includes car and motorcycle drivers, while Group 2 includes HGV drivers.
