Time between written notification of a hearing and the hearing
1st formal stage = 7 days
2nd formal stage = 10 days
3rd formal stage = 21 days
Lowest role that can investigate and lowest role that can conduct a hearing for each stage
Informal = crew manager
Investigation. Hearing
Stage 1 = WM. SM
Stage 2 = SM. GM
Stage 3 = GM. DAC
Discipline
The outcome of a hearing is to be confirmed in writing as soon as possible but within how many days
7 days
At stage 2 which role(s) may award a final written warning
GM ( or equivalent i.e. FRS level E)
Or above.
At Stage 3 following an investigation and hearing given what outcomes?
By which managerial Role
DAC or FRS G or h
1/ Dismissal
2/ Demotion ( no more than 1 grade can be more if employee agrees
3/ transfer ( with no loss of pay and on same shift unless employee agrees otherwise )
4/ Loss of pay upto max 13 days
How long after receiving a disciplinary action will employees be allowed to appeal
Not later than 7 days after being informed of the decision
On what grounds can an appeal be made
1/ a defect in procedure
2/ issue not proven on balance of probabilities
3/ sanction too severe
4/ new evidence available that will impact the decision.
Can be one or more of these
What constitutes Gross misconduct
Acts resulting in a serious breach of contractual terms and thus liable for summary dismissal.
It’s imp to establish facts before taking action.
Examples of Gross Misconduct
1/ Theft,Fraud 2/ Bribery 3/ Physical violence , bullying4/ deliberate serious damage to property 5/ serious misuse of Brigade property or name 6/accessing pornography 7/ discrimination, harassment 8/ bringing brigade to disrepute 9/ incapacity due to drugs, alcohol 10/ loss damage injury thru neglect 11/ breach H&S rules 12/ breach of confidence 13/ engaging in other employment paid or unpaid on brigade premises or in brigade time or when sick without express permission of authority 14/ engagement in employment without permission breaching staff conditions of contract 15/ utilising contacts, equipment, info not available to general public acquired during brigade work.
