court cases Flashcards
Kent vs. US (1966)
granted a child specific due process rights of having an attorney present at the hearing and access to the evidence that would be used in the case. States that transfer hearings now must have to provide legitimate transfer, sufficient notice to family and district attorneys, and a statement of reason for wanting a transfer.
In re Gault (1967)
reiterated that due process requirements must be met in juvenile court, made subject rights more similar to adult court
In re Winship (1970)
the amount of proof required in juvenile delinquency adjudications is also “beyond a reasonable doubt”
Breed vs. Jones (1975)
children are protected from double jeopardy after they are tried as a delinquent in juvenile court: once found to be a delinquent you could no longer be tried as an adult (5th amendment)
