Can you please define what communication is?
The imparting or exchanging of information by speaking, writing or using some other medium.
Can you please define what negotiation is?
- Discussions which are held to reach a compromise or agreement.
- Parties through an informal or facilitated negotiation process agree to settle a dispute.
What would you do following a negotiation meeting where a verbal agreement was made?
- I would look to formalise the verbal agreement as soon as possible, through issuing of written correspondence setting out what was discussed and agreed at the meeting.
- Within the written communication I would request that the other party confirm agreement by written response.
Can you explain how you would undertake strategic preparation within the context of negotiations?
- Establish with the client prior to negotiations any concessions and non-negotiable items.
- Ensure any prior correspondence with the other party involved in the negotiation in reviewed.
- Ensure all records are up to date regarding costs incurred and agreed.
- Establish who it is you will be negotiating with and what their main priorities are and how you may be able to satisfy their priorities as well as your client’s.
Can you explain how you validated the value of variations and interim payments at Sefton Avenue?
- I reviewed the costs provided by the contractor in line with the valuation rules set out within the contract.
- I assessed the works carried out on site against the claim made by the contractor up to the applicable due date.
At 17 Maple Grove you mentioned that you discussed your findings with the client at the end of the inspection. Was this done without first discussing with a senior colleague?
I provided my client with a summary of my initial thoughts and made clear that the content of the report and subsequent advice may change after a period of reflection, reviewing of site notes, photographs and review of my report by a senior colleague.
How did you communicate with your client at 17 Maple Grove in a clear and non-technical manner?
- I avoided use of technical language and ensured to discuss matters in a way that could be understood by the client.
- I pointed out to the clients the defects that were identified and explained the rationale behind by initial prognosis/diagnosis.
