Defense
Legal position taken by accused to defeat the charges against him or her
Probable Cause
Reasonable ground for belief, proven beyond doubt
Problems with the way evidence is obtained or the way an accused person is arrested, questioned, tried, or punished
Procedural Defenses
Disprove, justify, or excuse the alleged crime
Substantive Defenses
Self-defense
The use of force that is necessary to protect life or body of victim
Criminal Insanity
Accused doesn’t know between right and wrong
Immunity
Freedom from prosecution even if one has committed crime charged
Contempt of Court
Witness who will not testify after being granted immunity
Punishment
Any penalty provided by law and imposed by court
Plea Bargain
Accused person may agree to plead guilty to a less serious crime in exchange for having more serious crimes dropped
