Powerful leader who forces injured party to accept money or goods instead of taking revenge
Common Law
Law based on the current standards
Positive Law
Laws dictated from a central authority to prevent dispute and wrongs from occurring
Jurisdiction
Power of a court to decide a case
Equity
Basic fairness. Ex. Being able to blast music while driving even though its a public noise disturbance because there is a jack hammer on near by.
Precedent
Courts used prior cases as a guide for deciding similar new cases
Injunction
Court order for a person to do or not do a particular act
Four stages in the Growth of Law
- Individuals want revenge on wrong doers
- A sovereign stops this revenge from happening with a bribe
- Sovereign gives courts power to make a law
- Laws are enforced and punishment is set to prevent crime from happening
Advantages of English Common Law
Achieves uniformity while maintaining an ability to adapt to change.
