What are the 3 solutions to an unhappy marriage?
Desertion - one partner leaves the other but they remain legally married
Legal seperation - Courts seperate the financial and legal affairs of a couple but they remain married
Empty shell marriage - Couple continue to live under the same roof but remain married only in name.
Name Divorce Laws:
Divorce Reform Act 1969 - Irretrievable breakdown is only grounds for divorce - no longer had to prove adultery but must show marriage has broken down beyond repair.
Available after 2 years of separation.
Family Law Act 1996 - Increased wait time to file for divorce to 18 months which allows for a period of reflection. Couples must have compulsory counselling.
Required children’s wishes and financial arrangements to be agreed before divorce.
What is the trend with divorce?
Significant increase since the 1960’s.
Rates are 6 times higher than 1960’s.
About 50% of marriages will end in divorce.
