Negligence
Failure to exercise the degree of care considered reasonable under the circumstances, resulting in an unintended injury to the another party.
Duty of care
A requirement that a person act towards others and the public with watchfulness, attention, caution and prudence that a reasonable person, in the circumstances, would exercise.
