Legistation for animal boarding

A
  • Animal Boarding Establishment Act 1963
    ~ wales, scotland and northern ireland (existing licence holders in england but most ended)
  • The Animal Welfare (Licensing of Activities Involving Animals) (England) Regulations 2018
    ~ applies to all new licences and renewals
  • Animal welfare act 2006
    ~ need to care for 5 freedoms
    ~ can be prosecuted if not

Animal Boarding Establishment Act 1963

A
  • covers same aspects as The Animal Welfare (Licensing of Activities Involving Animals) (England) Regulations 2018
  • must have a licence
  • must not have any previous convictions
  • seizing body reserve right to arranged inspections without notice
  • evacuation plan
  • adequately trained staff
  • mobile phones switched off (rescue)
  • BUT 2018 regs aim to close lots of loop holes and cover updated means of business which aim to reduce
    ~ puppy farming
    ~ illegal puppy trade
    ~ improve welfare standards for all animal related business
  • was meant to be updated for each country in march 2020 but covid delayed this, should be done in near future

  • Full review of lighting, heating, ventilation and water supply must be provided

Conditions

  • council will inspect the premises once first payment paid before giving a licence, and any time after the licence is granted.
  • 2 part payment for licence
    ~ recipt to prove payed 1st part of licence fee when submit application
    ~ met critieria = pay 2nd part
  • Guidance notes provided by DEFRA outline conditions which must be complied with in order to be granted a licence
  • A business that meets higher standards will be able to gain 4 or 5 star rating in the Animals Activity Star Rating System
  • This allows businesses to qualify for longer licence and thereby pay a lower licence fee and less inspections
  • Whilst applying higher standards is optional, certain standards are required to obtain higher star rating

  • need it has to be housed with, or apart from, other animals, and
  • need to be protected from pain, suffering, injury and disease.

  • All animals must be transported in suitable containers
  • Seizing authorities have further legal obligations
  • Requirement under the Highway Code that animals should be suitably restrained (Rule 57, Highway Code)
  • Any vehicle transporting dogs must be suitable and have correct ventilation and temperature control
