No employee shall be terminated or disciplined, nor shall any employee suffer any adverse employment consequence, solely because he or she has sought referral to the EAP for treatment of alcohol or substance abuse. This protection shall apply to the employee only if:

A current employee of the department may be required to submit to a test for drug or narcotic usage as outlined below:
- The Chief of Police may order a drug test to be performed on a specific employee when there is reasonable suspicion to believe that the employee is using illicit drugs or substances. “Reasonable suspicion” may include, but not be limited to, the following indications of drug usage: reduced productivity, excessive vehicle accidents, high absenteeism or other behavior inconsistent with previous performance. The basis of the reasonable suspicion shall be divulged to the employee upon request.
- The Chief of Police, the Deputy Chief, an Assistant Chief, or the Internal Affairs Commander may order a drug test to be performed on a specific employee when there is reasonable suspicion to believe that the employee is under the influence of alcohol and or drugs while on duty.
- In addition to all other drug tests which may be required of any employee, employees may be chosen on a random basis to submit to drug tests pursuant to the provisions of Section VIII below.
