Regulatory Taking
The government is intending to regulate and that regulation which the government believes is the common good for the people ends up negatively impacting a particular property owner in such a way that they initiate a lawsuit claiming that the governments actions amount to a taking.
Regulatory takings typically, in most instances deal with the government passing a law and that law having such a negative impact on a particular individual that they feel as though their property has been taken and as such they want just compensation. !!

What is public use?
Property can be taken for uses which are beneficial to the public.
Initially, the property had to be put into direct use and occupancy. For example, the government could take your property to widen the road, because everybody has access to the road. Or the government could take your property to create a public park, because everybody has access to a public park. Those things still qualify as a public use, but it is going to get a lot more interesting when someone wants to take your department store bulldoze it down and put shiny new apartments there, that doesn’t feel as much like a public use, but as we are going to see the government has some creative interpretations of how far the _______ ______ can extend.
