Section 4 Interpretation?

A

Immediate family:
Means a member of the victims family, whanau or other culturally recognised group who is in a close relationship with the victim at the time of the offence.

Incapable:
Means that the person:
Lacks, wholly or partly the capacity to understand the nature and to foresee the consequences.
Has the capacity to to understand the nature and to foresee the consequences but wholly lacks the capacity to communicate.

Victim:
A person who an offence is committed
A person who through by means of an offence committed by another person suffers physical injury
Suffers any form of emotional harm
A person who has experienced domestic violence and a child or YP residing.

A

Assist the court in understanding the victims views
Inform the offender about the impact of offending
