Section 136 Declaration of an emergency
Enforcement officer has reasonable grounds to believe that there is an emergency:
And no state of emergency has been call,
Emergency is not being dealt with by Fire,
Emergency not declared by section 144 Biosecurity act.
No other enforcement officer has declared an emergency.
Enter any premises
Remove the cause of the emergency
Stabilise the situation
Protect the health and safety
Enforcement officer may declare a hazardous or new organisms emergency.
They must:
Identify themselves,
State authority (136)
Announce the nature of the emergency.
Emergency declared under this section:
Cease:
After 48 hours
When SOE declared
Emergency treated by fire
Emergency declared under Biodiversity Act.
Section 137 Emergency powers
Enter any dwelling or premises Direct any person to stop activity Take any action to limit extent of emergency Direct to leave Direct from entering Requisition any property Secure for 24hrs
