Detain person for up to 2 hrs to allow for necessary power to issue. Starts once decision made to serve.

A

Police should contact the person at risk while the PSO is in place preferably within 24- 48 hrs of order being served.

  • check for any breaches
  • ensure person at risks understands what constitutes a breach.

Unless impractical to do so Police should also re visit the bound person while the PSO in place if considered high risk.

Actions for breaching a PSO.

A

Although breaching is not an offence the bound person can still be taken into custody. May use reasonable force.

Bring them before court within 24 hrs.
Make a complaint to the court requesting that it makes order.
If person cannot be brought before the court within 24 hrs must be released and summons to appear.

Issuing PSO’s to children.

A

A PSO can be issued under sec 28 to children aged 16-17 as part of a frontline safety plan, if the order is justified by special circumstances.
