Parents or guardians are usually entitled to the services however if they have been charged or under investigation for the offence then it would not be within the victims best interest for the offender to receive these services

Close relatives or nominated family spokesmen of a person whose death was directly caused by a criminal offence is entitled to the rights and services under the victims code

Yes, a nominated spokesman can access theses under the code if the victim had a mental impairment or has been so badly injured because of a criminal offence.
