Victim Rights Act 2002, s7 - Courtesy and compassion.
Anyone who deals with a victim, treats them with courtesy, compassion, and respect for their personal dignity and privacy.
Victim Rights Act 2002, s8 - Access to services.
Allowing the victim and their family access to services. i.e. welfare, counseling, medical or legal needs that has been caused from the offence to the victim.
Victim Rights Act 2002, s11 - Inform victims of services available.
Victim should be given any info as soon as practicable, by any agency, i.e. police, about what services are available to them to help. Anyone else effected by the offence.
Victim Rights Act 2002, s12 - Supplying information.
Victim should be given any info about the progress of the investigation, any charges filed/actions taken, court dates, what is required of them as a witness, and outcomes of any proceedings.
Victim Rights Act 2002, s51 - Return of property.
Any property (other than offenders) should be returned to them asap, when it is no longer needed as evidence.
Under VRA 2002, describe ‘Victim’
Anyone who has had an offence committed against them, by suffering physical/mental injury, or loss of or damage to property.
Included parent/legal guardian/immediate family of CYP affected by an offence.
CYP who witnesses FH.
Anyone involved in offence not found guilty.
VRA 2002, s29, Specified offence defined
Is an offense of a sexual nature, serious assault, serious injury, death or someone becoming incapable.
Any offense that leads the victim having ongoing fears for their safety/security, or to their immediate family.
VRA 2002, s29 - obligations this section puts on police?
- ASApracticable Commissioner of Police determine if a Specified Offence.
- ASApracticable victim informed of right to be on VNR.
- If victim chosen to go on VNR.
Why maintain contact with victims of crime?
- Short/long term reactions need to be monitored.
- After ‘impact stage’ comes ‘recoil stage’, trauma can have life-long effects.
- Police need to help during the stages.
Purpose of CSV1 form?, who receives?
- Ensures victim recieves support from Court Victim Advisor.
- Court Victim Advisor receives completed form.
When to use and where to locate POL 1065?
- Use it to place the victim on the VNR (Victim Notification Register).
