MHA 1992. Power to return a Special/Restricted or Compulsory treatment patient after AWOL?
Restricted/Special back to hospital at anytime.
Compulsory treatment patient AWOL within 3mths, return to hospital. After 3mths considered released.
Who can apply for a Compulsory Mental Assessment of another person?
Relative over 18yrs, or doctor who carries out initial exam.
Special patient?
Criminally insane, unfit to plead. Detained by court.
Restricted patient?
Subject to Compulsory treatment order, but presents danger to the public.
