Frezze, Control, Preserve - explain?
Freeze: the scene to remain in its original state it was found.
Control: people in the scene and those attempting to leave or arrive.
Preserve: any evidence at the scene that may be destroyed of decay in some way.
Common Approach Path (CAP) - Explain?
Assessing the best approach path that everyone arriving to the scene.
Avoid any location the offender could have taken if possible, so not to destroy evidence.
Reasons to Arrest: WEEP stands for?
Witness/victim is protected.
Ensure court appearance/other resolution.
Ensure preservation of evidence.
Prevent further offences.
Powers of arrest without warrant?
CA 1961, s315(2)(a)(b).
SOA 1981, s39(1)(2).
When arresting you must?
- Say you are under arrest. PLUS - physically touch then. OR - Offender agree under arrest.
Timeframe for holding someone in breach of peace?
2hrs.
Unless charging with offence.
Crimes Act 1961, s316 - Duties when arresting?
Any person arrested must be given reason at time, unless:
- reason is obvious.
- impractical to do so.
