This law states that an employer may not discriminate against a physically or mentally disabled person in recruitment, hiring, promotions, training, pay, social activities and other employment privileges. Signed by Bush (1990)
Americans with Disabilities Act (ADA)
Employers may not discriminate against 5 protected classes: race, color, religion, national origin, and sex. Signed by Lyndon Johnson (1964)
Civil Rights Act (Title VII)
Modified the ‘64 Civil Rights Act - allowed jury trials for employee disputes, established requirements for employer defense, and placed limitations on punitive damages based on # of employees (1991)
The Civil Rights Act
Applies to federal contractors and all organizations receiving grants from the federal government. Requires these employers to ensure all employees are in compliance with its drug-free requirements. Must have drug-free policy. Drug testing not a requirement (1988)
Drug-Free Workplace Act
Amended the Civil Rights Act of ‘64 by redefining some terms. Also required employment poster for work locations (1972)
The Equal Employment Opportunity Act (EEOA)
Prohibits employers from using genetic information to make employment decisions (2008)
The Genetic Information Nondiscrimination Act (GINA)
States that time resets with each new paycheck for time to file a charge of an illegal act of discrimination by an employee. Signed by Obama (2009)
The Lilly Ledbetter Fair Pay Act
Defined pregnancy as protected under “sex” under the Civil Rights Act (1978)
The Pregnancy Discrimination Act (PDA)
Requires all steps in a hiring decision be validated for application to the job being filled using validity study or job analysis (1976)
