Doctrine of prior appropriation
The right to divert ground water in AZ. “first in time, first in right”.
Ground water
Water under the earth’s surface. Does not include water flowing in underground streams with ascertainable beds and banks
Surface water
Waters of all sources; flowing streams, canyons, ravines. Or in definite underground channels, floodwaters, wastewaters, surplus waters.
Effluent water
Water that has been collected in a sanitary sewer for subsequent treatment in a facility
ADWR requirements
Requires all wells drilled be reported to the Dept. Also a notice of a change in ownership of the well
Under the Groundwater Code, exemptions-
Exempt wells pumping 35 gallons per minute or less and nonexempt wells that pump over 35 gallons per min
When selling vacant land
Buyer must be made aware of the requirements of adding a waste disposal facility on the property if a sewer hookup is not available. A permit will be required for a conventional septic system
Alternative waste disposal systems
Aerobic system and a mound septic system
Environmental concerns requiring disclosure in AZ
Arsenic in groundwater, radium, radon, lead in old paint and pipes, mold, exterior insulation and finishing system, propane tanks, wood infestation, roof rats, scorpions
