Intended to create a marketplace in which personas of similar financial means have a similar range of housing choices
Civil Rights Act of 1866
Prohibits all racial discrimination in real estate transactions with no exemptions. Jones vs Mayer 1968
Federal Fair Housing Act
Title VIII of Civil Rights Act of 1967. Prohibits descrimintaion in housing based on race, color, national origin, religion, sex, familial status, or disability

Fair Housing Amendments Act of 1988
Added disability and familial status to protected classes
HUD
Enforces the Fair Housing Act. A complaint must be brought within 1yr of alleged act. Within 100 days of filing a complaint that is not referred by HUD to a local enforcement agency, HUD dismisses or goes forward with a charge of illegal discrimination.
Exemptions from Fair Housing Act
-Rentals in owner occupied buildings with no more than 4 units
-Housing operated by organizations and privates clubs that limit occupancy to members
-Sale or rental of a single family home when fewer than 3 homes are owned by an individual, discriminatory advertisements is not used, and a real estate pro is not involved
Housing for Older Persons Act of 1995 (HOPA)
Repealed facilities and services requirements for housing intended for persons 55 or older. Exempt from familial status protection if its restricted to persons aged 62 or older, or if 80% of units are occupies by persons aged 55 or older
Familial Status
Extends fair housing protections to families with children
Conciliation
The resolution of a complaint within 100 days of filing when a respondent promises to remedy a violation
Administrative Law Judge (ALJ)
Hears complains brought to HUD
Remedies
Fine or Injunction. A civil action my be brought in federal court by the complaint within 2yrs of the alleged act. The attorney general my bring a civil action in federal court. Complaints under Civil Rights Act of 1866 go directly to federal court.
