AZ follows HUD occupancy standards
Require owner to adopt and publish reasonable occupancy standards when renting. Limitation of 2 persons per bedroom
Occupancy considerations when renting
-tenants with felonies must be considered on case-by-case basis not a blanket policy
-familial status is protected by fair housing laws
-illegal to discriminate against disabilities including hoarding
-Service/ assistive animals allowed
Who has possession?
Whoever has the keys
Security deposit
Belongs to the tenant, held by the owner/ property manager, to ensure the property is returned in the condition it was received or as outlined in the lease agreement
If a notice is mailed by registered/ certified mail, the tenant or landlord is deemed received…
on the date it is actually received or 5 days after the date it was mailed, whichever occurs first
How must a landlord send a notice of abandonment?
Certified mail, return receipt requested, addressed to tenant’s last known address, and post a notice of abandonment on the property for 5 days
Curable notice
Occurs if a breach of lease can be remedied by payment of money or by repair, and the tenant cured the breach within a time frame specified in the breach notice. The lease will not terminate
Noncurable notice
Occurs with material flasification, a second breach and that is the same or similar in nature during the lease, or irreparable breach. These all qualify for immediate removal of the tenant
5-day nonpay notice
non-pay for overdue rent
10-day breach notice
For complaints of noise, smells, debris, parking, unauthorized occupants, unauthorized pets
