What are Civil Rights?
Positive actions government should take to create equal conditions for all, like the Due Process Clause or Equal Protection Clause.
What does the 3rd Amendment state?
No forced quartering of soldiers in homes.
What are Civil Liberties?
Protections against government actions, like the Bill of Rights.
What does the 7th Amendment state?
The specific rights of the accused in a civil case. (Right to jury trial in federal civil cases should the cost exceed $20).
What does the 10th Amendment state?
Powers not given to the federal government in the Constitution belong to the States.
How does the Supreme Court incorporate the Bill of RIghts?
They apply the liberties in Bill of Rights to state laws and actions to limit the powers of State Governments. They use selective incorporations made on a case by case basis to apply liberties from Bill of Rights to the States. The 3rd, 7th, and Grand Jury Clause of the 5th Amendment not yet incorporated.
