what is the role is tribunals

A

deals with specific areas of law generally concerning social and welfare legislation such as employment rights, heard by tribunal judge and two lay people, two types of tribunals: in house and administrative- UNDER TRIBUNAL COURT AND ENFORCEMENT ACT 2007, two tiers to it which is first and upper tier

Heard by a panel of three consisting of a tribunal judge and to lay persons who have expertise in the area in dispute

advantages of tribunals

A
  • much cheaper and in many cases quicker than going to court
  • Legal aid is available usually for human rights issues such as immigration or mental health issues
  • from July 2017 you do not need to pay fees to make an employment tribunal claim

disadvantages of tribunals

A
  • public funding is not available in most cases so the individual has to bear the cost
  • there may be a delay in hearing the case especially if it involving employment law
  • The powers of tribunals are very limited as they can only give out fines and penalties
