Whats criminal law?
Designed to prevent offenders from carrying out the offence again
What is civil law?
Aims to correct unfair situation - often by compensating the victim, and the aim is the leave the victim back in the situation before they were wronged.
What is duty of care?
In tort law, a duty of care is a legal obligation that is imposed on an individual, requiring adherence to a standard of reasonable care to avoid careless acts that could foreseeably harm others, and lead to claim in negligence. It is the first element that must be established to proceed with an action in negligence.
What is standard care
In tort law, the standard of care is the only degree of prudence and caution required of an individual who is under a duty of care. The requirements of the standard are closely dependent on circumstances
Whats the difference between civil and criminal law?
● Most criminal cases would be dealt with in a Magistrates or Crown Court
●Civil cases are usually heard in the County Court or High Court
●These are dependent upon the amount of damages or degree of harm involved
