The equality act
2010
this replaced all existing law on discrimination.
Simplifies all current laws and put them together in one piece legalisation.
This act protects us against direct and discrimination if also protects us against harassment and victimisation.
Example in the olden days a black disabled women wouldn’t know which act to use.
9 protected characteristics.
- Age
- Disability
- Sex
- Race
- Marriage and civil partnership
- Pregnancy and maternity
- Religion
- Sexual orientation
- Gender reassignment
Discrimination by association
If you are married to a Chinese man it would be illegal for people to discriminate against you for being associated with them.
Perception discrimination
Can’t be treated unfairly because of a thought so it would be illegal for someone to treat you unfairly because they think you are gay.
Third party harassment
In a workplace it being protected from harassment by a third party e.g. Cleaners or builders (anyone from outside the setting).
Benefits of this Act
it makes the law stronger in some places.
Makes it illegal to ask health and disability related questions before short listing or offering someone a job unless these is a justified reason.
Gives rights to pregnant and breastfeeding women up to 6 months e.g. Can breast feed where ever they want.
Protects transsexuals and people associated with transsexuals ( cannot be treated any differently).
Strengths of the equality act.
It simplifies the current law
It protects more people and give them more rights e.g. For the first time ever breast feeding woman are protected.
It introduced new definitions of discrimination (indirect and direct).
Weaknesses
Discrimination still goes on.
The rights for employees can be a burden on employers.
Giving rights to some group can contravene rights of other groups.
