Reissuance of Conflicting Written Directives

Transfers
Employees shall be notified of their new assignment at least ____ days prior to the transfer, except where the nature of the situation requires an emergent reassignment.

A grievance is defined as:
A dispute involving the interpretation or application of this Agreement.
Grievances challenging demotion with loss of pay, suspension with loss of pay or termination shall be filed at Step IV.
Review Article 9: Grievance Procedure
(You have 10 days to give the assistant chief written documentation of the grievance, the assistant chief has 10 days to conduct a meeting, and 10 days after the conducted meeting assistant chief has allotted time to issue a response)

–> For each step, after the assistant chief, the grievance must be presented to the next “step” within 5 days, 10 days to meet the next step, and 10 days for the next step to tell you their decision (then start the process over)

Arbitration Procedure:
The grievant or the FOP (on behalf of the grievant) may request arbitration by providing a written request to the JSO Chief of Human Resources within 30 days after receipt of the final step IV response or when the step IV response is due
The arbitrator shall render his or her decision within ___ days of receipt of post-hearing briefs or of the close of the hearing, whichever is later.

Controlled Substance:
Any of the substances named in schedules I-V of Section 893.03 Florida Statues and any designer drugs that may hereafter be proscribed by law and which are subject to manufacturing, distribution, preparation, dispensation, and administrative controls.

Illegal Drug
Any drug or substance, including controlled substances, the possession of which without a prescription is defined as a violation of state or federal statutes; or any prescription drug that was not prescribed to the affected employee by a person licensed to issue such prescription
Legal Drug
Any prescription medication or over-the-counter medication that has some medical value/purpose and is being used by the person for whom it was prescribed
Substance Abuse
The excessive or erratic ingestion consumption inhalation or injection of any illegal drug or illegally obtained drug or medicine not prescribed in amounts or at proper time intervals
Use of Drugs
The injection, inhalation, ingestion, or consumption of any drug, whether prescription or non-prescription, or any controlled substance as defined under Florida law
“Under the Influence”
A condition in which employees are unable to appropriately perform their duties because of the use of any drug, controlled substance, or alcohol. Employees shall be deemed to be under the influence if they are physically or mentally impaired and, or unable to perform their duties in acceptable manor
Information relating to the use of over-the-counter drugs can be removed at the request of the employee after it has been in the medical file for ___ months unless the usage of such medication is part of ongoing treatment.
