Law: Sexual Interference
Every person who, for a sexual purpose, touches any part of the body of a person under the age of 16
Sentence: MIN= 1 year MAX= 14years
Canada: Age of consent= 16
-> Close in age exemptions
#1: 12-13 yr old ok w one less than 2yr older
#2: 14-16yr old ok w one less than 5yr older
Consent Culture & Children
- Bodily Autonomy:
->Children have the right to decide what/who can touch their body - Naming Body Parts:
->Teach children the proper names of body parts
= Avoid shame and protects from predators
Sexual Grooming def
The deliberate process involving manipulation tactics where an adult builds trust w a child to exploit them sexually
Grooming steps (6)
- Target the victim
-> Looks for vulnerability: low parental monitoring, low self-esteem - Gain trust
-> Love bomb the victim w attention and gifts:
lots of 1 on 1 time or befriending the parents - Fill a need
-> Offers solution to child’s problem: housing, friendship, money - Isolate child
-> Use step 2 (Gain trust/gifts) against you, or make you believe they are the only ones who care for you:
“Those girls are jealous of you, not your true friends”
“I am the only one who understand you” - Sexually exploit
-> Normalizes inappropriate content/touches
= desensitize the child from sexuality - Maintain control
-> Use guilt and blackmail
DSM-5 DX of Pedophilia
Criteria A.
Over a period of at least 6mo, recurrent, intense sexually arousing fantasies, sexual urges, or behaviors involving sexual activities w a prepubescent child or children (gen. age 13 or younger)
Criteria B.
The person has acted on these urges, or the sexual urges or fantasies cause marked distress or interpersonal difficulty
-Problems w intimate contact w age appropriate partner
Criteria C.
The person is at least 16 years of age and at least 5 years older than the child or children in A
Specify Type:
- Exclusive= Only attracted to children
- Nonexclusive= Attracted to children AND age-appropriate
*note: NOT include late adolescence involved in an ongoing sexual relationship w a 12-13 yr old.
Other classifications
- DSM-5 Pedophilia DX applies to 5% of male adults
- Classified as Paraphilia
- Predatory Pedophile= acts on their sexual urges-> only 1/2 of 5% are predatory pedo
Cognitive distortions
More likely to believe that children
-> Benefit from sexual contact = educational value
-> Initiate sexual contact
-> Derive pleasure

MAY 1996
-> Sex offenders who are released from prison must be: Registered and Community notified
Tier (3) classification (Risk of Recidivism) dictates who is entitled to receive community notification
Tier 1: Low risk- Law enforcement only
Tier 2: Moderate risk- Law enforcement AND schools, daycares and registered agencies
Tier 3: High risk- Law enforcement, daycares…, and general public

Sexual Offense against adults
Categories of Sexual assault:
LEVEL I- Harms sexual integrity of victim
- Ranges from unwanted touch to intercourse
MIN= none MAX= 10 years
LEVEL II- W a weapon or causing bodily harm
MIN= None w/out weapon, 4 w one MAX= 14yrs
LEVEL III- Aggravated sexual assault
- Victim is seriously wounded or at risk of death
MIN= Same as II MAX= life
