Controlled Drugs and Substances Act (6 schedules)
Schedule 1: Most serious crime-> Heroin
- with severe consequences-> MAX= 25 yrs in prison
Schedule 6: Least severe crime-> Marijuana
- consequences-> MAX= Fine of ~ $1000
Leary Rule (1978)
Prevents using Voluntary Intoxication as a defense to a serious crime (intoxication replaces men reas)
*Not applied to Homicide
Rv Daviault (1994)
- “Nice” man, known alcoholic, 60yrs old
- Friend of his wife ask if Dav. can bring her a bottle of Brandy, since she is disabled (in a wheelchair)
- D. first goes to a bar and has 8 beers
- Then goes to buy the Brandy and visits the friend
- D has a glass of Brandy w/ friend
- Friend goes to sleep and D. finishes the bottle of Brandy
- D. SA friend
-> Defense claims Automatism: Extreme Intoxication =Acquittal
Women’s rights activists protested-> LEARY RULE VIOLATED
-> 2nd trial found guilty- 1yr sentence in jail
Rv Chan
- 19yrs old football player that endured a TBI recently
- Took mushrooms
Effects on him: Psychotic + hallucinations - Kill his dad
-> Will enter Automatism plea: Extreme Intoxication
Degrees of Intoxication (3)
- Mild Drunkenness-> Treated as sober (0.08)
- Advanced Intoxication-> Above 0.08- no cut-off/limit
- Extreme Intoxication-> Very high level of drugs in system =Automatism (=Acquitted)
1&2 for non-violent crimes
SUD DSM-5 DX
Mild: 2-3 sxs
Moderate: 4-5 sxs
Severe: 6sx or more
- Criteria A: Impaired control over substance use
- Criteria B: Social Impairment
- Criteria C: Risky use of the substance
- Criteria D: Pharmacological criteria
Criteria A: Impaired control over substance use SX (4)
- Substance is often taken in larger amounts or over a longer period than intended
- Persistent desire or unsuccessful efforts to cut down or control substance use
- Great deal of time spent in activities necessary to obtain the substance =, use the substance, or recover from it’s effects
- Craving
Criteria B: Social Impairment SX (3)
- Recurrent substance use resulting in a failure to fulfill major role obligations (work, school, home)
- Continued substance use despite having persistent/recurrent social/interpersonal problems caused/exacerbated by the effects of the substance
- Important social, occupational, or recreational activities are given up or reduced because of substance use
Criteria C: Risky use of the substance (2)
- Recurrent substance use in situations in which it is physically hazardous/dangerous
- Substance use is continued despite knowledge of having a persistent physical/psychological problem that is likely to have been caused/exacerbated by the substance
Criteria D: Pharmacological criteria (2)
- Tolerance- Needs more of the substance to achieve same high
- Withdrawal- Unpleasant physical/emotional effect when a substance is ceased.
usu. substance is taken to relieve these unpleasant effects= vicious cycle
SIP DSM-5 DX (5)
A. Prominent hallucinations or delusions
B. Evidence that Criteria A developed during or w/in a month of substance use/withdrawal
C. Exclusion- not accounted due to another psychotic disorder that is not substance-induced
D. Not during a delirium (sudden/onset, temporary, underlying medical cause: fever with disorientation)
E. Causes distress or impairment
Alcohol SIP: Delirium Tremens (DTs)
Can occur during prolonged drinking or during withdrawal. Usu lasts 3-6 days, genrally followed by deep-sleep.
SX:
- Disorientation
- Hallucinations
- Fear
- Extreme suggestibility
- Marked tremors

- orders all alcohol to be thrown away
- 3 days later-> hallucinating, trembling, disoriented, fear
- Scared of his 2nd mate= drowns him
