What is a constitution?
- The system of laws, customs and conventions which define the composition and powers of organs of the state and regulate the relation of the various state organs to one other and to the private citizens. (Prof. Hood Philips).
- Is a document setting out the rules and relating to the structure of thr state.
State how the constitution was made?
The Constitution Planning Committee spent two years collecting opinions on the desired type of government justice and law and written the final Report. On 23rd May 1975, the Constitution Assembly convened for the first time to debate and discuss the final Report and it resolved in August 15th 1975 to adopt the Constitution. On the 16th September 1975, the Constitution became the supreme law of PNG.
State three main body of a democratic Government?
- Legislature - the law-making authority in PNG which is the National Parliament.
- Executive - the whole system of government (administration) or the National Executive Council (NEC).
- Judiciary - courts system.
What are the basic rights under Division 3 of the Constitution?
The four basic rights are:-
1. Right to freedom (s.32)
2. Right to life (s.35)
3. Freedom from inhuman treatment (s.36)
4. Protection of the Law (s.37)
