What is section 15?
It is entry without warrant to find and avoid loss of evidential material when dealing with a 14+ year offence.
-If you have RGTB that EM related to the offence is in a PLACE.
-AND
-If entry is delayed the evidence may be CADD.
-YOU MAY
-Enter and search without warrant.
What is section 17
Warrantless entry and search of a vehicle in public. Need RGTB that evidence of a 14+ offence is in the vehicle.
What is section 16?
Warrantless search of a person for evidential material of a 14+ offence. Need RGTB they have the EM. They need to be in Public.
What is section 118?
Power of detention.
You can detain any person who…
-Is in the place or in the vehicle at start of search
OR
-Arrives at the place while the search is happening
OR
-Stops at, or enters or tried to enter the vehicle or place while the search is being carried out.
What is Section 119?
Powers to search persons at a place or vehicle.
-If RGTB that evidential material you are looking for is on the person.
OR
-You have RGTS that the person has in their possession a dangerous item and you believe that immediate action is needed.
Search one person at a time.
Section 116 (1) (a)
Secure place, vehicle or other thing
Section 116 (1)(b)
Exclude person from place, vehicle or thing.
Section 116(2)
When exercising the 116 powers you must identify yourself if asked.
