What is section 114?
The power to stop any car by signal or lights for traffic related offences.
What is Section 95?
28 day licence suspension.
Used when…
-failed breath or blood test for alcohol
-drive more than 40kph over the permanent limit.
-drive more than 50kph over temp speed limit.
What is section 115?
Allows officers to prohibit vehicle by giving pink and green stickers.
Green= does not comply with rules
Pink= not in safe condition
What is section 121?
Gives the power to forbid someone from driving. Used when someone in driving dangerously and you think they need to stop. Can forbid someone for Upto 12 hours
What is Section 90?
Suspending licenses and disqualifying drivers.
-demerit loss is 3 months loss of license
-people who lose license have to go renew it
What is section 113?
Used to demand passenger details of applicable.
What is section 96?
Impounding a vehicle for 28 days if:
-RGTB they are disqualified, suspended or not holding a license.
-Not meeting interlock conditions
-They fail a breath test or blood test
-They refuse blood test or breath test
-They have caused bodily injury or death to someone while carelessly driving.
-They were driving 40kph over speed limit.
-Sustained loss of traction
-Etc
What is section 122 & 123
-122 is power to seize a vehicle for 12 hours if it is in the interest of public safety.
-123 is power to to seize a vehicle for Upto 10 days to preserve evidence, enable scientific examination or establish the cause of a serious traffic incident.
What is section 119?
Power of entry to carry out a breath alcohol test. Lets you enter a building if someone has been signalled to stop and they have ran into a building. May also enter a building where section 96 & 123 apply.
