What is the procedure for dealing with intoxicated people?

A
  • Take the person home, unless not safe or impractical
  • Take the person to a temporary shelter, unless closed or unavailable
  • Take to a police station for up to 12 hours to sober up

What rights does an intoxicated person have?

A
  • Statutory caution rights must be given as ther are being detained under an enactment.
  • If detained at a police station, allowed to make one phone call.
  • Released as soon as sober or if still intoxicated after 12 hours Dr must recommend further detention.
  • Can be searched under sect 85 of S&S + RAN

How should you deal with children or young persons that you find intoxicated?

A
  • Persons under 17 found intoxicated, the same provisions of the policing act apply
  • Concerns for CYP should be directed to Youth Aid

What is the definition of intoxification?

A

Intoxication is if the person is observably affected by 2 or more of the following:

  • Appearance is affected
  • Balance is impaired
  • Co-ordination is impaired
  • Speech is impaired
