What is a record ?
information created, received and maintained as evidence and as an asset by an organisation or person in pursuance of legal obligations or in the transaction business
Public records act 1958
- employees are responsible for any records that they create or use in the course of their duties
- including records controlled by NHS organisations under contractual or other joint arrangements, or as inherited legacy records of defunct NHS organisations
Local Government Act 1972
proper arrangements must be in place with respect to any documents that belong to or are in the custody of the council or any of their offices
freedom of information act 2000
governs access to and management of non personal public records.
creates transparency in government and allows any citizen to know about the provision of public services through the right to submit a request for information
UK GDPR AND DATA PROTECTION ACT 2018
- the UK gdpr is the principal legislation governing how records, information and personal data are managed.
- sets in law how personal and special categories of information may be processed
Private prescriptions for POMS
- Retained for 2 years from the date of supply
- records must be made in the pom register
- schedule 2 and 3 cds need to be submitted to the relevant NHS agency
Veterinary Prescriptions
- retained for 5 years
CD register
all schedule 1 and 2 controlled drugs received or supplied by a pharmacy need to be recorded within the controlled drugs register
- record should be kept for 2 years from the date of last entry
