Police Safety Order
Who can issue a PSO
Any constable can issue but has to authorised by a qualified constable (SGT)
Who is a bound interest?
The person agains whom the order is issued becomes a bound person
When to consider a PSO>
If no offence is apparent but will escalate or continue when Police leave
PSO - Section 124B
Considerations - Welfare of any children, Hardship, Bound person is likely to use harm against the person at risk, mental illness
PSO - Section 124C
Police do not need consent
PSO - Section 124E
PSO includes the person at risk, the person named in the order and any child residing with that person
PSO - Section 124D
PSO cannot be issues against a child
PSO - Section 124I
Fails or refuses to remain at the place where they have been detained, commits punishable offence - S500
PSO - Section 124E
Must immediately surrender any weapons or firearms licence
PSO - Section 124K
No longer than 5 days
PSO - Section 124H
Must be served within 48 hours
PSO - Section 124L
Breach - maybe taken into custody if they fail or refuse to comply with the order - detained
PSO - Section 124M
Only 24 hours in custody, if can’t be brought in front of a judge then they must be released, served with a summons.
