Ten Minute Period
After you explain the advice a positive EBT - They have the choice to speak to their lawyer, 10 minutes to decide whether they want blood (allow 12).
Imprisonable
20 and Over - Exceeds 400
17 - 20 - Exceeds 150
Section 59 (1A) (1B)
1A - Fails or refuses to remain
1B - Fails or refuses to accompany
Section 60 (1A) (1B)
1A - Fails or refuses to give blood when required by an enforcement officer.
1B - Fails or refuses to give blood when requested by a medical practitioner
Arrest Policy
Necessary to complete breath/blood.
Reasonable grounds to believe - risk to public safety by driving again while impaired.
Doubt about their identity.
Doubt that they will be able to be located for serving summons.
To ensure that jeu will appear inn court.
