Definition of ‘Mental Disorder’
Abnormal state of mind. Characterised by delusions, or by disorders of mood, perception, volition or cognition of such degree that it:
- Poses a serious danger to the health or safety of that person or others
- Seriously diminishes the capacity of that person to take care of themselves
What are your powers for dealing with patients absent without leave?
Restricted / Special Patients - absconded or are absent without leave may be apprehended and returned/taken to hospital at anytime.
Compulsory treatment patient - absent without leave or fails to comply with an order maybe apprehend and return / taken to hospital within three months of going missing.
What are your powers in relation to mentally disordered people in public place?
Section 109 - Any member of Police may apprehend any person wandering at large in a public place if they are behaving in a manner that gives rise to a reasonable belief that they may be mentally disorder and the member believes it is the interest of the person or public to do so.
What are your powers in relation to assisting medical practitioners?
Section 110 C - Any member of Police called upon in such circumstances may: enter the premises by force if necessary to detain the person in those premises until the assessment examination has been conducted. Or take the person to some other place nominated by the medical practitioner, for the purpose of a medical examination or an assessment examination, and detain at the location until the examination has been conducted.
What is positional asphyxia and what procedures would you follow to prevent it?
Bodily position results in a partial or complete airway obstruction. Do not transport them in a prone position.
What is the Police role in assisting a DAO under section 41 of the Act?
Section 41 - A Duly Authorised Officer may call upon the assistance of any member of Police so that they may assess a patient or transport a patient for assessment or treatment.
Any member of Police when called upon may enter the premises by force if necessary, detain the person in those premises until the assessment examination has been conducted, take the person to some other place nominated by the DAO for the purpose of a medical assessment.
What does GI M908 say in relation to Police powers to use force?
Do not use force when transporting a patient without ensuring that an assessment notice has been served on and explained to them.
Force can only be used in circumstances where the patient is a danger to themselves or others.
What does the memorandum of understanding between New Zealand Police and the Ministry of Health say in relation to the transportation of mentally disordered people?
Must advise them of their rights when you detain or transport them under the mental health act.
Purpose if the Mental Health Act 1992
To ensure that people suffering from a mental disorder receive the appropriate psychiatric treatment.
Restricted Patients
These are patients who are detained by way of a court order if they are found to be criminally insane or unfit to plead. The category also includes people on remand for a psychiatric report.

These are patients who are detained by the way of a court order if they are found to be criminally insane or unfit to plead. The category also includes people on remand for psychiatric report.
Duly Authorised Officer DAO
DAO iare qualified nurses who have specialised in the area of mental health and the received further training on an ongoing basis.
Section 109
